Terms of Service — IBI

1. Acceptance of Terms

By using the IBI application ("the App"), you fully accept these Terms of Service ("Terms"). If you do not accept these Terms, you may not use the App.

Using the App constitutes a binding contract between you and Gianni Campana ("IBI", "we", "us"), owner and operator of the service.

These Terms should be read together with the Privacy Policy available in the App, which governs the processing of your personal data.

2. Eligibility

2.1 Age Requirement

IBI is reserved exclusively for persons aged 18 or over. By registering, you declare that you are at least 18 years old. If we discover that you are under 18, your account will be deleted immediately.

2.2 Other Requirements

To use IBI, your account must not have been previously suspended or deleted for violation of these Terms; you must not be legally prohibited from receiving digital services under applicable law; and you may not hold more than one active account (one account per person).

3. Registration and Account

3.1 Truthful Information

You agree to provide accurate, complete, and up-to-date information during registration and in your profile. You may not create an account with false information, impersonate another person, or use another person's name, photos, or identity without their consent.

3.2 Account Security

You are responsible for the confidentiality of your credentials and all activities performed on your account. Notify us immediately at support@ibimeet.com if you suspect unauthorised access.

3.3 One Account Per Person

Creating multiple accounts to circumvent a suspension or ban constitutes a serious violation of these Terms.

4. Rules of Conduct

4.1 Prohibited Behaviour

Towards other users: do not harass, threaten, intimidate, stalk, or abuse other users; do not send unsolicited explicit sexual content; do not repeatedly contact users who have expressed a wish not to be contacted; do not share other users' personal information without their consent.

Regarding your profile: do not post photos that are not of you, create fake or catfish profiles, or provide false information about yourself.

Regarding content: do not post illegal, offensive, racist, sexist, violent, pornographic, or discriminatory material; do not post content that violates third-party intellectual property rights or depicts child abuse.

Regarding platform use: do not use IBI for commercial or advertising purposes without written authorisation; do not spam; do not use bots or automated scripts; do not attempt unauthorised access; do not scrape other users' data; do not interfere with the App's servers.

4.2 Reporting Abuse

You can report a user directly from within the App. We review all reports and take appropriate measures, including account suspension or deletion.

5. User Content

5.1 Ownership and Licence

You retain ownership of the content you upload to the App. By uploading content, you grant us a non-exclusive, worldwide, royalty-free, transferable licence solely to: display your content to other users; store and transmit it in connection with the service; resize and compress photos for technical performance. This licence automatically terminates when you delete the content or your account.

5.2 Representations

By uploading content, you declare that you are the author or have the legal right to use it, and that it does not violate any third-party rights or these Terms.

5.3 Content Removal

We reserve the right to remove any content that, in our discretion, violates these Terms or is otherwise inappropriate, without prior notice.

6. Intellectual Property

The App, its design, source code, logo, and the name "IBI" — excluding user-uploaded content — are the exclusive property of Gianni Campana and are protected by copyright and intellectual property law. Copying, modifying, distributing, selling, decompiling, or creating derivative works without written authorisation is prohibited.

7. Service Availability

We provide the App "as is". We do not guarantee continuous availability or the absence of bugs. We may temporarily interrupt the service for maintenance and reserve the right to modify, suspend, or discontinue any feature at any time.

8. Limitation of Liability

8.1 General Limit

To the extent permitted by applicable Italian law: we are not liable for indirect, incidental, special, or consequential damages; our total liability for any claim shall not exceed the amount you paid for IBI services in the last 12 months (or €10 if the App was used free of charge).

8.2 User Interactions

IBI facilitates connections between people but is not responsible for the actions of other users, in-person meetings, or damages arising from interactions outside the App. Always use caution: when meeting someone in person, always choose public and populated places.

8.3 Mandatory Consumer Rights

Nothing in these Terms excludes or limits rights that the law does not permit to be excluded, including liability for wilful misconduct, gross negligence, or personal injury.

9. Indemnification

You agree to hold harmless and indemnify Gianni Campana / IBI from any claims, losses, damages, or expenses (including reasonable legal fees) arising from: your violation of these Terms; content you uploaded; your conduct towards other users; or your violation of third-party rights.

10. Account Suspension and Deletion

10.1 Voluntary Deletion

You may delete your account at any time via Settings → Delete Account. Deletion is irreversible after the 30-day soft-delete period described in the Privacy Policy.

10.2 Suspension by Us

We may suspend or delete your account, with or without notice, if you violate these Terms, endanger other users or the platform, or if we are required to do so by law.

10.3 Effect of Deletion

Upon deletion, the licence granted under these Terms terminates immediately. Your data is handled as described in the Privacy Policy (30-day soft-delete, then permanent deletion).

11. Premium Features (Future)

The App is currently free of charge. Premium features may be introduced in the future with adequate prior notice. In-app purchases are subject to Apple App Store or Google Play Store policies.

12. Governing Law and Dispute Resolution

These Terms are governed by Italian law. For disputes with users acting as consumers, the competent court is that of the consumer's domicile or residence (Italian Consumer Code, Legislative Decree 206/2005).

13. Right of Withdrawal (EU Consumers)

Under Legislative Decree 206/2005, you have the right to withdraw from the contract within 14 days of registration without giving a reason. However, by expressly requesting the immediate start of the service and using the App before the 14-day period expires, the right of withdrawal lapses once the service has been fully performed pursuant to your explicit prior request (Art. 59.1.a Directive 2011/83/EU).

14. Changes to These Terms

For material changes, we will notify you via in-app banner and/or email with at least 15 days' notice. Your continued use constitutes acceptance. If you do not accept the changes, you may delete your account before the effective date without penalty.

15. General Provisions

• Severability: if any provision is held invalid, the remaining provisions remain in full force
• No waiver: failure to exercise a right does not constitute a waiver of that right
• Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and IBI regarding use of the App
